Said Charles Caldas CEO Merlin, Global Rights Body For Independent Sector:
“It is incredibly disappointing that MySpace will launch their new service without having finalised a deal with the world’s most important independent labels and artists. It certainly makes Chris DeWolfe’s public statements*, that the “indie bands are really the heart of MySpace”, ring extremely hollow.

“What is absolutely clear, however, is that any independent deal struck without an equity component (as was done with the majors), will see independent labels face a situation whereby their major competitors will profit from the use of their repertoire without an appropriate upside opportunity being extended to them by MySpace Music and its Major Label equity partners.

“Whilst Merlin continues our negotiations, we remain extremely concerned that with MySpace Music the major record labels are acting not only as competitors, but through their equity stakes in the venture, as the clients/end user as well. Without an equitable participation by independents, that creates a situation that is both unhealthy and dangerous.

“Merlin, the global rights agency represents the largest basket of rights outside of the majors labels, with a US market share equivalent to that of the smallest majors”

The Recording Industry Association of America (RIAA) applauded full Senate passage of the Enforcement of Intellectual Property Act of 2008 by Sens. Patrick Leahy (D-Vt) and Arlen Specter (R-Penn.) that would provide additional resources and funding to help strengthen the protection of intellectual property at home and abroad. The House of Representatives is expected to pass the Senate legislation before Congress adjourns, sending the bill to the President for signature into law.

At a critical economic juncture, this bipartisan legislation provides enhanced protection for an important asset that helps lead our global competitiveness. Specifically, S. 3325 will:

1) Prioritize the federal government response to domestic intellectual property crimes by streamlining the coordination and improvement of interagency efforts

2) Provide grants to the Department of Justice to assist state and local law enforcement agencies in enforcing intellectual property‑related crimes

3) Devote additional agents and resources to the FBI for the study, implementation and active enforcement of efforts against intellectual property and counterfeiting crimes

4) Provide tools to better gather evidence for the prosecution of IP crimes

ed Nugent Reaches Out To Sarah Palin

Sarah Palin was the first name on TED NUGENT’s list to receive an advance copy of TED, WHITE & BLUE: THE NUGENT MANIFESTO, comprised of 16 chapters on how to fix America. This week, the multi-platinum guitar icon, best-selling author and outspoken activist sent the book?due October 6 via Regnery Publishing?to Palin with a note in praise of the vice presidential nominee’s “bold spirit.”

ASCAP proposal would impede online music sales and harm consumers. The Digital Media Association (DiMA) asked a federal district court to rule that online retailers’ use of 30-second music preview clips are “fair use” and do not justify public performance royalties as demanded by songwriter and music publisher representatives.

“DiMA supports fair compensation for copyright owners,” stated Jonathan Potter, Executive Director of DiMA. “DiMA members pay tens of millions of dollars in royalties to songwriters and publishers for online music sales. But the performing rights organizations (ASCAP, BMI and SESAC) who represent songwriters and publishers demand additional payment for the preview clips that facilitate these online sales.”

Today DiMA (joined by the National Association of Recording Merchandisers) asked the court to reject that argument and rule that 30-second promotional samples are used to inform and promote online sales and therefore constitute fair use for which no additional royalties are due.

Courts have consistently found that using copyrighted content to provide product information that ensures consumers are well-informed and facilitates a trustworthy marketplace is fair use. DiMA and NARM’s amicus brief filed today supports an underlying case in which AT&T Wireless has asked the court to extend that protection to 30-second samples that promote the sale of ringtones and ring-back tones. DiMA and NARM specifically ask that the court consider the importance of 30-second preview clips for all Internet retailers.

“Internet retailers sell an extraordinary percentage of all recorded music,” continued Potter. “The iTunes Store is America’s largest music retailer, and Amazon.com, Best Buy and other DiMA members use 30-second clips to sell both CDs and digital downloads. If ASCAP succeeds in pressing its demand for a new payment for these previews, Internet music retailers would be disadvantaged simply because they are selling online, and songwriters and music publishers would be getting a royalty for the preview on top of the appropriate and well-deserved royalty that is paid when the music itself is sold.”

The Strategy Analytics Wireless Media Strategies service report, “Can Nokia Challenge Apple’s Digital Music Dominance,” examines Nokia’s potentially game-changing service, “Comes with Music,” which bundles music access with mobile phones. What impact could it have, and how will it affect other music stores?

The major drivers for mobile music are in place, but service adoption has not been as strong as many predicted. Strategy Analytics survey data shows that although 83% of respondents use their phones to play music, only 6% of music tracks on devices are from mobile stores, a clear disappointment to mobile operators.

“Strategy Analytics data shows that price and selection are the most important factors in a customer’s choice of music store, and that brand loyalty is extremely low. In this environment, even Apple cannot count on retaining users when competing with an offer that seems free to the end user,” said David MacQueen, Director of the Strategy Analytics Wireless Media Strategies service and author of the report. “Comes with Music and other bundled services, should they succeed, offer a lifeline to the music labels which have seen revenues decline sharply in the digital age,” he added.

David Kerr, Vice President at Strategy Analytics, noted, “‘Comes with Music’ is Nokia’s biggest step so far in its transition from a hardware company to a software and services strategy. There are some key unanswered questions and challenges to overcome, but our survey data shows clear latent demand for such an offering. 84% of respondents were willing to pay for a service such as ‘Comes with Music’.”

She has the ability to transform an exigent job into a exciting life. Judy tells us how: “I think that anyone working in this business has to love their job, and I most definitely do. Sometimes, I really don’t want to be away from home for two months at a time, but in all honesty, I can’t think of anything else that I could do that would bring me so much happiness and fulfillment. I return to so many of the same cities each year that the buyers and people I meet there are my friends, and I consider them my extended family. I am so very, very lucky to live this wild and crazy, truly exciting life.”

Interview with Rodrigo Haddad: “From Brazil to TN”

The new of his last international award has reached Rodrigo Haddad in one of his sweetest moments of his career. He has just recorded his new album, “From Brazil to TN”, and is ready to be one of the big stars of the next San Pedro Country Music Festival, the largest country music festival in South America. Raúl Tejeiro, President of the Country Music Association of Uruguay, interviewed him about this special moment and his new work:“My new album means a lot to me. It’s a dream come true! I’m so happy about the result of the tracks, and I can’t wait for country music fans to listen to it. The experience is unique when you record an album in Nashville. I’m really proud of it and, for sure, it’s a big step in my career”.

Rodrigo has played in many different countries and venues and talk us about that experience: “I’ve been traveling a lot since I started thirteen years ago. Brazil is really huge, and there’s so much more to see. I’ve been going to Argentina for the past six years, and Nashville is another place where I’m always playing my music, too. Multi-Platinum Rock and Roll Hall of Famer Sammy Hagar will release a new album on Loud & Proud Records on November 18th. Cosmic Universal Fashion marks the first official release for Loud & Proud, a Roadrunner Records imprint focusing on established artists. The title track and first single, “Cosmic Universal Fashion,” was written as an online collaboration between Hagar and a young Iraqi rock and roller by the name of Steven Lost. Released via Sammy’s website RedRocker.com and already a YouTube sensation, the video was produced in the same spirit as the classic Van Halen video for “Right Now, ” and strikes a timely chord with November’s upcoming Presidential election.

Bug Music, Inc., one of the world’s largest independent music publishers, has secured a new $200,000,000 credit facility, which can be increased to $250,000,000. The facility, priced at the London interbank offered rate (Libor) plus 2.50%, was led by investment bank JP Morgan, it was announced today by Bug Music CEO John Rudolph.
